FDA Restrictions on Avandia because of Avandia Side Effects
In fact, heart attacks triggered by Avandia became so prevalent that the Food and Drug Administration (FDA) took the unusual step of restricting the use of the rosiglitazone-containing medicine on May 5, 2011.
Under this strict edict, the FDA has forbidden Avandia to be prescribed to new or existing patients unless they fall into one of only two categories:
1. Patients who already have been successfully treated with the drug and haven’t suffered from any of its Avandia side effects.
2. Patients whose blood sugar levels will not respond and cannot be controlled by any other medications – after first consulting with their doctor.

“A new review from the Mayo Clinic shows that most researchers who reported positive results in numerous studies of Avandia had financial ties to the pharmaceutical companies,” O’Brien wrote.
The exact percentage of those researchers with such financial ties to Avandia’s makers was 94%, with 25% of them not disclosing these financial ties, according to O’Brien.
Lawsuits vs. Statute of Limitations On Avandia Side Effects
As a result, numerous lawsuits have been filed against GlaxoSmithKline on behalf of the families of patients suffering fatal side effects or for patients themselves, who experienced life-threatening situations after using Avandia,
Many of these lawsuits are being filed and settled in favor of the plaintiffs. Some say this is prompting the pharmaceutical giant to fight new cases by claiming they fall under the statute of limitations.
GlaxoSmithKline recently tried but failed to get a federal judge to limit Avandia claims to those filed in 2007. But on Sept. 7, 2011, U.S. District Judge Cynthia Rufe denied this request and ruled in favor of lawyers representing patients suing the company.
She agreed with their argument that public knowledge about Avandia’s heart attack side effects was not available until the summer of 2010.
